How To Protect Yourself Before A Divorce?

For many couples, marriage is a wonderful, beautiful partnership. But for others, marriage turns out to be a nightmare. The reality is that about half of all marriages end in divorce.

If you're staring down the face of an impending divorce, you're not alone. Ist, you need know your assets. Assets mean (home, real estate, cars, personal property, IRA, cash...etc). Before you can proceed with anything else, you need to know how much money you have and where it is.  Get everything in writing. Everything. Michigan divorce and family court court may  not care about proof of your spouse's affair, it will care about proof of your assets, so start compiling as much documentation as possible.

Valuable divorce advice: Do not transferring assets to third parties, into trusts or moving them offshore. The Michigan divorce courts will view such actions as done with the intent to deceive the court and can reverse any such transfers.

Parties to a divorce are required to make full disclosure of their financial arrangements for at least the 12 months preceding the divorce (and in some cases even earlier) and so any movement of your assets can usually be picked up through an analysis of bank statements, investments and company accounts. 

Moving out of your marital home: as hard as it may can be, it may be advisable to stay living in the marital home with your spouse and the children (call us for advice). If either party moves out, it may benefit the remaining party in arguing that he/she has the main care of the children and therefore has a greater housing need.  It may also leave the remaining spouse in a more comfortable position financially, which often does not assist in incentivizing him/her to resolve the matter swiftly.
