An uncontested divorce occurs when: (a) there are no disputes or disagreements between you and your spouse over any financial or divorce-related issues (i.e., child custody and support, division of marital property or spousal support); and (b) your spouse either agrees to the divorce or fails to to file a formal response with divorce court. More clear that all factors, i.e. marital home, assets, debts, custody, visitation, alimony, child support, even the family dog, have been amicably resolved between the Husband and Wife. 

In an uncontested action, the spouses go separate ways without a trial and in some cases, without even appearing in court.
Contested divorce means you and your spouse could not agree on the terms of the divorce, or even whether there should be a divorce at all. Some examples of issues that must be resolved prior to the court granting a divorce in Michigan are child custody, child support, spousal maintenance, division of property and debts.

In contested divorces, a judge will have the final say in all terms of the divorce, and will decide:
